BACKGROUND: The Revolutionary Communist Student Brigade (RCYB) was a radical left wing Marxist Lenninist organization led by Gregory Lee "Joey" Johnson. During the 1984 Republican National Convention in Dallas, Johnson burned the United States flag to protest the policies of the Reagan Administration. Johnson was arrested and convicted, but had his conviction overturned on appeal. The State of Texas then pursued the case all the way to the Supreme Court. In Texas v. Johnson, a five-justice majority of the court held that Johnson’s act of flag burning was protected speech under the First Amendment to the United States Constitution. In an ironic twist, the courts strongly worded decision was written by conservative Justice Anthony Scalia. Many commentators have noted that although the ultra conservative Scalia and the radical communist Johnson disagreed on almost everything, they could still agree on something as important as freedom of speech.
